1. Acceptance of Terms

By accessing or using the services, website, or applications (“Services”) of Goda Online Services Pvt Ltd (“Goda,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use our Services.

2. Eligibility & Age Restriction

To use our Services, you must be at least 18 years of age. Participation in the Goda Rewards Program and associated mini-games is strictly restricted to legal adults. By using the Services, you represent and warrant that you meet this age requirement.

3. Description of Services

Goda provides an online platform that allows users to view and purchase food from restaurants and cafes near to their location.

4. User Accounts & Mandatory KYC

• Registration: You must provide accurate information when creating an account.
• Verification: Users participating in coin-based games may be required to complete KYC verification to comply with Indian regulations.
• Security: You are responsible for maintaining the confidentiality of your account credentials.

5. User Obligations & Conduct

You agree to use our Services only for lawful purposes. You must not engage in illegal activities, attempt unauthorized access, or use automated means to farm loyalty points.

6. Platform Usage Fee

• General Authorization: Goda Online Services Pvt Ltd reserves the right to levy a nominal Platform Usage Fee on all users of the platform, including Customers, Restaurant Partners, and Delivery Partners. This fee is essential for the continuous maintenance, security, and technical optimization of the Goda ecosystem.
• Fee Determination: The specific amount of the Platform Usage Fee shall be determined at the sole discretion of Goda Online Services Pvt Ltd. The fee may vary based on factors such as service type, order volume, or operational requirements and will be clearly displayed to the user before any transaction is finalized or during periodic settlements.
• Continued Use and Acceptance: By continuing to access and use the platform, all users acknowledge and agree to these charges. Goda reserves the right to modify, waive, or update the fee structure as needed, with notice of significant changes provided through the application interface or registered communication channels.

7. Goda Loyalty Rewards Program

• Nature of Coins: Goda Coins are loyalty reward points and not virtual currency. They have no real-world monetary value and are not legal tender.
• Skill-Based Games: Coins may be used in skill-based mini-games to unlock discount vouchers.
• Redemption: Rewards are non-transferable and cannot be exchanged for cash.
• No Resale: Coins cannot be traded or sold outside the platform.

8. Tax Compliance (Section 194BA)

As per the Income Tax Act, any net winnings from in-app games (including voucher value) are subject to 30% TDS. Goda ensures tax compliance before reward release.

9. Intellectual Property

All content, logos, and materials are the property of Goda or its licensors. Unauthorized use, copying, or distribution is prohibited.

10. Termination

We may suspend or terminate accounts for violations. All unredeemed coins and vouchers will be forfeited upon termination.

11. Limitation of Liability

To the maximum extent permitted by law, Goda is not liable for indirect or consequential damages arising from the use of Services.

12. Dispute Resolution & Grievance Redressal

• Arbitration: Disputes will be resolved through arbitration in Kochi, Kerala under Indian law.
• Grievance Officer: Complaints will be addressed within 7 days as per IT Rules 2021.
